ATHLX Terms of Use

  1. 1. Introduction

    Our Platform provides assessment services for mental and physical tests and sports assessments. By using our application, you agree to follow and be bound by these terms and conditions, which govern your use of our application.

  2. 2. Definitions

    1. Privacy Policy: In this agreement, the privacy policy refers to the privacy policy posted on the Athlx.ai.
    2. Platform: In this agreement, platform means Athlx.ai.
    3. User: In this agreement, the user means all those who sign up on the platform.
    4. Account: Account in this agreement means the user space that users have exclusively by signing up on the platform.

  3. 3. Service Description

    Our Platform offers assessment services for body condition and physical elements including some physical tests, and anthropometry elements and we will calculate the growth grade. This may include the use of a questionnaire or other tools to gather information about your body condition and physical elements.

  4. 4. General

    1. 4-1- Any type of unauthorized access to the platform, whether it is creating a user account with a fake identity or by any other means other than registering with a real identity, is considered unauthorized access and will be prosecuted.
    2. 4-2- Athlx has no obligation for direct, incidental, consequential, indirect and criminal damages resulting from your access and use of the platform.
    3. 4-3- Any content and claims related to Athlx that are published through other natural and legal persons on applications, websites, blogs, or social networks and other media are the responsibility of the publisher, and Athlx has no responsibility for them.
    4. 4-4- All Athlx communications with users will be through system messages or official identifiers available on the app or site and Athlx social media introduced on the app or site, and Athlx will not be responsible for any other calls under its name.

  5. 5. Account

    1. 5-1- To sign up those who are under 18 years old, their parents must sign up on the platform. Those who are over 18 years old are allowed to join the platform. Athlx has the right to immediately block the account of any member who has not reached the age of 18, and in this case, it is obvious that his use of the application is considered abuse and Athlx reserves the right to prosecute it.
    2. 5-2- Athlx has the right to suspend the account of insulting people, slanderers, and persons who try to destroy the image of Athlx for any reason and to refuse to provide service to them. After removal, these persons will not have the right to work on the application again, but they can provide their explanations by contacting Athlx email, if it is convincing for us, their account will be reactivated, but we will not be responsible for this.

  6. 6. Use of Information

    The information and data gathered through the application are collected solely to provide the service requested by the user. We will ensure that user information is kept confidential and used only for the purpose it is intended for. Please refer to the privacy policy for details of this use.

  7. 7. Your Responsibility

    1. 7-1- You as a user, agree that it is your responsibility to ensure that any information you provide to us is accurate, complete, and up-to-date. You also agree that it is your responsibility to keep any login credentials or passwords associated with your account secure.
    2. 7-2- Users are obliged to protect their personal information and the data that the platform provides as their physical assessment, and they will be responsible for publishing the results of these assessments on their social networks.

  8. 8. Limitation of Liability

    We shall not be liable for any damages arising out of or in connection with your use of our application, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

  9. 9. Indemnification

    You agree to indemnify and hold harmless Athlx AI LTD, its officers, directors, employees, and affiliates, from any claim or demand, including reasonable attorney’s fees, made by any third-party due to or arising out of your use of our application, your breach of these terms and conditions, or your violation of any rights of another person or entity.

  10. 10. Intellectual Property

    All content on our application, including but not limited to text, formulas and algorithms, graphics, logos, images, and software, is the property of Athlx AI LTD or its content suppliers and is protected by intellectual property laws. You may not use any content on our application without our prior written consent.

  11. 11. Limiting User

    According to this agreement, without accepting any kind of responsibility, Athlx AI LTD can limit the user's account temporarily or permanently ban the user's activity, or cancel or limit his membership. if the user does these:

    1. - When the agreement is violated
    2. - If Athlx AI LTD cannot be sure about the information provided by the user

  12. 12. Governing Law

    These terms and conditions shall be governed by and construed in accordance with the laws of Canada, without giving effect to any principles of conflicts of law.

  13. 13. Changes to Terms and Conditions

    We reserve the right to modify these terms and conditions at any time, without prior notice. Your continued use of our application following any changes to these terms and conditions constitutes your acceptance of such changes.
